Tony Danza divorce saga: Just what is a legal separation?

On behalf of Stange Law Firm, PC posted in Legal Separation on Thursday, February 14, 2013.

It was recently reported that after 24 years of marriage, Tony Danza is officially divorced.

Danza, the star of “Who’s the Boss,” and his second wife, Tracy Danza, filed for divorce in March 2011. The two cited “irreconcilable differences.” At the time of the filing, the two had already been legally separated for a number of years. In fact, when the divorce became official earlier this month, this was already more than six years after their legal separation.

Upon hearing this news, many might now be wondering just what a legal separation is and how it relates to divorce.

Of course, the laws change from state to state, but in Missouri, couples can choose to enter into separation agreements. Under these agreements, couples can make decisions regarding things like child custody, child support, property division and alimony. Separation agreements can also even spell out the specifics of parenting and visitation.

In Missouri, there is no separation requirement for couples wishing to file for divorce. However, for couples who do go the route of separation, keep in mind that these agreements should be taken very seriously. If a separation leads to a divorce, these separation agreements will most likely have a significant impact on the divorce settlement.

This is why it is important to talk with a family law attorney in Missouri when making decisions regarding separation agreements. This attorney can help to look out for a person’s best interests both now, and into the future, should a divorce be filed.
