USFSPA and your military divorce

41537249_S.jpgUSFSPA refers to the Uniformed Services Former Spouses' Protection Act, which was an Act established to ensure that the former spouses of individuals who serve in the military would receive a share of the retirement benefits that said former spouse earned from service. Essentially, under Missouri law, the retirement pay of those who serve or have served in the military is considered marital property, and just like other marital property, it is subject to being divided during a divorce.

This is just one area of the law that affects how a military divorce can play out, and further examples of how military divorce differs from a civilian divorce. For some members of the military, the retirement benefits received from service are only part of their assets, and there could be retirement benefits from a career pursued outside of the military as well.
